Face Dr Ireland Terms of Service / Terms & Conditions

These Terms of Service and Terms & Conditions (“Terms”) apply to your use of the website at ie.myfacedr.com (the “Site”) and to products and services purchased through the Site.

Please read these Terms carefully before using the Site or placing an order. By using the Site or placing an order, you agree to these Terms. If you do not agree to them, please do not use the Site or place an order.

These Terms apply to consumers purchasing products for personal use in the Republic of Ireland. We do not currently ship to Northern Ireland, Great Britain or any other country through the Site.

In these Terms, “Face Dr”, “we”, “us” and “our” mean Face Dr EU Limited.

2. Eligibility and Use of the Site

You must be at least 18 years old to use our online skincare consultation services or place an order through the Site.

By using the Site, you confirm that:

  • you are legally capable of entering into a binding contract;
  • the information you provide to us is accurate and complete;
  • you will use the Site lawfully and in accordance with these Terms; and
  • any products purchased are for your personal, non-commercial use.

If you are purchasing on behalf of a business or for resale, you must contact us before placing an order. We reserve the right to cancel orders that appear to be placed for resale or commercial distribution.

3. Products and Services

We sell skincare products and may provide online skincare consultations, product recommendations, personalised skincare routines and related customer support through the Site.

Product descriptions, photographs, packaging and colours are provided for general information. We make reasonable efforts to ensure that product information is accurate and up to date, but the appearance of packaging and colours may vary between products and devices.

Products are subject to availability. We may update product information, change product formulations or packaging, withdraw products or limit quantities where reasonably necessary. Any such change will not affect an order that we have already accepted, unless the change is required by law or the product is no longer available.

Products must be used in accordance with the product packaging, instructions and any information provided by the manufacturer. You should carry out any recommended patch testing and follow all relevant usage instructions.

Nothing on the Site prevents you from exercising your statutory rights in relation to products that are faulty, unsafe, not as described or otherwise do not conform to the contract.

4. Skincare and Medical Disclaimer

Information provided through the Site, including information provided during an online skincare consultation, is for general skincare and educational purposes only.

Our online consultations and product recommendations:

  • are not a medical diagnosis;
  • are not a substitute for advice, diagnosis or treatment from a doctor, pharmacist, dermatologist or other qualified healthcare professional;
  • do not establish a doctor-patient or other clinical relationship; and
  • should not be relied upon as the sole basis for making decisions about a medical condition.

We do not represent that every product sold through the Site is a medicine, medical device or treatment for a medical condition.

You should seek advice from a qualified healthcare professional before using a product if you:

  • have a diagnosed skin condition;
  • are pregnant or breastfeeding;
  • have known allergies or sensitivities;
  • are taking medication that may affect your skin; or
  • experience a serious, persistent or worsening reaction.

Stop using a product and seek appropriate medical advice if you experience a severe or unexpected reaction. In an emergency, contact the emergency services or attend your nearest emergency department.

5. Orders, Contract Formation and Payments

5.1 Placing an order

When you place an order through the Site, you are making an offer to purchase the selected products.

Before submitting your order, you will have an opportunity to review and correct your order details. You must check that your delivery address, contact details, selected products and quantities are correct.

You must use the payment button or other clearly marked order button to confirm that placing the order will require payment.

5.2 Order confirmation and acceptance

After you submit an order, we will send an email acknowledging receipt of your order. This acknowledgement does not necessarily mean that we have accepted your order.

A contract between you and Face Dr will generally be formed when we send you a dispatch confirmation email, unless we notify you that the order has been accepted at an earlier time.

We may decline or cancel an order before acceptance where there is a legitimate reason, including:

  • the product is unavailable;
  • there is an error in the product description or price;
  • we are unable to deliver to the address provided;
  • we reasonably suspect fraud, unauthorised payment or unlawful activity;
  • the order appears to be for resale or commercial distribution; or
  • cancellation is required by law.

If we cancel an order after payment has been taken, we will refund the amount paid using the original payment method without undue delay.

5.3 Prices and payment

All prices on the Site are displayed in euros (€) and include VAT where applicable. Delivery charges and any other applicable charges will be clearly shown before you submit your order.

Prices may change from time to time, but changes will not affect an order that we have already accepted.

We accept the payment methods displayed at checkout. Payment must be authorised before an order can be dispatched. You confirm that you are authorised to use the payment method provided.

We do not knowingly charge more than the amount displayed at checkout, except where an additional charge is expressly authorised by you or required by law.

6. Delivery

6.1 Delivery area

We deliver through the Site to addresses in the Republic of Ireland only.

We do not currently deliver through the Site to:

  • Northern Ireland;
  • Great Britain;
  • the Channel Islands;
  • the Isle of Man; or
  • any other country or territory outside the Republic of Ireland.

We may cancel and refund an order if the delivery address is outside our delivery area.

6.2 Delivery times

The estimated delivery timeframe and delivery charge will be displayed at checkout.

We will deliver your order within the timeframe stated at checkout or, if no timeframe has been agreed, without undue delay and no later than 30 days after the contract is formed, unless a different period is agreed with you.

Delivery times are estimates and may be affected by circumstances outside our reasonable control. If we do not deliver within the agreed period, you may have rights under the Consumer Rights Act 2022, including the right to require delivery within an additional reasonable period or, in appropriate circumstances, terminate the contract and receive a refund.

6.3 Delivery and risk

Delivery is complete when the products are physically delivered to you or to a third party nominated by you, other than the carrier.

The risk of loss or damage passes to you when you, or a third party nominated by you, takes physical possession of the products. Risk does not pass merely because the products have been handed to a carrier selected by us.

We remain responsible for the products while they are in transit where required by law.

If your order is damaged, defective, incomplete, incorrect or appears not to have been delivered, please contact us promptly at hello@myfacedr.com. This does not limit any statutory rights or time limits that apply to you.

6.4 Events outside our reasonable control

We will not be responsible for delay or failure to perform an obligation where this is caused by an event outside our reasonable control, such as severe weather, natural disaster, epidemic, industrial action, interruption to transport or communications networks, or action by a public authority.

This clause does not affect your statutory rights. If an event outside our reasonable control substantially delays delivery, we will contact you where reasonably possible and take reasonable steps to minimise the impact.

7. Returns, Cancellation and Refunds

Our separate Face Dr Ireland Return & Refund Policy forms part of these Terms.

7.1 Statutory right to cancel

For most products purchased online, you have a statutory right to cancel your order without giving a reason within 14 days after the day on which you, or a person nominated by you other than the carrier, receive the goods.

Where an order is delivered in separate consignments, the cancellation period generally begins when you receive the last product, lot or piece.

To exercise this right, you must inform us of your decision to cancel before the cancellation period expires. You may do this by emailing hello@myfacedr.com or by sending any other clear statement of cancellation. You may also use the model cancellation form set out in the Return & Refund Policy, although use of that form is not mandatory.

After informing us of your cancellation, you must return the goods without undue delay and no later than 14 days after notifying us, unless we have agreed to collect them.

7.2 Return costs and condition of goods

Unless we have agreed otherwise, you are responsible for the direct cost of returning goods when you cancel because you have changed your mind, provided that we informed you of this obligation before the contract was made.

You must take reasonable care of products while they are in your possession. You may be responsible for any diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the products.

For health protection and hygiene reasons, the statutory cancellation right does not apply to sealed skincare products that are not suitable for return once the seal has been unsealed after delivery. This may include skincare products that have been opened, used or tampered with.

This restriction does not affect your rights where a product is faulty, unsafe, not as described or otherwise does not conform to the contract.

7.3 Refunds following cancellation

Where you validly cancel an order under the statutory cancellation right, we will refund the payments we have received from you, including the cost of standard delivery.

If you selected a more expensive delivery method, we are only required to refund the cost of the least expensive standard delivery option available.

We will normally issue the refund using the same payment method used for the original transaction and will not charge you a refund fee.

We may withhold the refund until we have received the returned goods or you have provided evidence that you have sent them back, whichever occurs first, unless we have offered to collect the goods.

7.4 Faulty, defective or incorrect products

If a product is faulty, defective, unsafe, not as described or otherwise does not conform to the contract, you may have rights and remedies under the Consumer Rights Act 2022.

Depending on the circumstances, these remedies may include repair, replacement, price reduction, termination of the contract and a refund.

We will not charge you for the reasonable cost of returning a product that is faulty, defective, incorrect or not as described. Please contact us at hello@myfacedr.com so that we can arrange an appropriate remedy.

Nothing in these Terms or the Return & Refund Policy limits or excludes your statutory rights.

8. Intellectual Property

All content on the Site, including text, product descriptions, graphics, logos, photographs, videos, designs, software and other materials, is owned by Face Dr or licensed to us.

This content is protected by Irish, European and international intellectual property laws. You may access and use the Site for personal, non-commercial purposes only.

You must not, without our prior written permission:

  • copy, reproduce, republish, distribute or commercially exploit Site content;
  • modify or create derivative works from Site content;
  • use our trade marks, logos or branding;
  • scrape, data-mine or systematically extract Site content;
  • use Site content to operate or promote a competing business; or
  • remove copyright, trade mark or other proprietary notices.

If you submit a review, photograph, comment or other material to us or to the Site, you confirm that you have the right to do so and that the material is lawful, accurate and not misleading. You grant us a non-exclusive, royalty-free licence to use, reproduce and display that material for the purposes of operating, improving and marketing our services, subject to applicable data protection law. We may remove user-submitted content that is unlawful, offensive, misleading or otherwise inappropriate.

9. Privacy and Data Protection

We process personal data in accordance with applicable data protection law, including the General Data Protection Regulation (EU) 2016/679 (“GDPR”), the Irish Data Protection Act 2018 and applicable electronic communications and cookie rules.

Our Privacy Policy explains:

  • the types of personal data we collect;
  • the purposes and legal bases for processing;
  • how we use consultation information and any information relating to skin or health;
  • the service providers and other recipients with whom data may be shared;
  • how long information is retained;
  • your data protection rights; and
  • how to contact us or make a complaint.

Please review our Privacy Policy before using the Site or providing consultation information.

Information about skin, health or allergies may constitute special-category personal data under the GDPR. You should only provide such information where it is necessary for the service and where you understand how it will be used.

We may use cookies and similar technologies in accordance with our cookie information and applicable law.

10. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

This includes liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of your statutory consumer rights;
  • defective products where liability cannot lawfully be excluded; or
  • any other liability that cannot be excluded or limited under Irish law.

Subject to the above, we will be responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for:

  • losses that were not reasonably foreseeable when the contract was formed;
  • losses caused by your breach of these Terms;
  • damage caused by misuse of a product, failure to follow product instructions or use contrary to professional advice; or
  • temporary unavailability, interruption or alteration of the Site where this is reasonably necessary for maintenance, security, updates or circumstances outside our reasonable control.

Nothing in this section affects your right to seek a repair, replacement, price reduction, termination or refund where provided by Irish consumer law.

11. User Responsibilities and Acceptable Use

You must not use the Site:

  • for any unlawful, fraudulent or unauthorised purpose;
  • to interfere with the security or operation of the Site;
  • to introduce malicious code, viruses or harmful material;
  • to impersonate another person or provide misleading information;
  • to infringe another person’s intellectual property, privacy or other rights;
  • to harvest or collect information about other users without permission; or
  • to place orders for resale or other commercial distribution without our prior agreement.

You are responsible for keeping your account details and login information confidential and for activities carried out through your account, unless the activity is caused by our failure to maintain appropriate security.

If you materially breach these Terms, we may suspend or restrict your access to the Site or cancel an order where reasonably necessary. We will not use this right to avoid or restrict your statutory consumer rights.

You are responsible for losses that we reasonably incur as a direct result of your deliberate misuse of the Site or material breach of these Terms, to the extent permitted by law. This does not apply to losses caused by our negligence, breach of contract or failure to comply with applicable law.

12. Governing Law and Jurisdiction

These Terms and any contract between you and Face Dr are governed by Irish law.

If you are a consumer, you may bring proceedings in the Irish courts. You may also have the right to rely on mandatory consumer protection laws and bring proceedings in the courts of the country where you live, where applicable.

Nothing in these Terms removes or restricts any mandatory rights or protections available to you under Irish or European consumer law.

You may contact the Competition and Consumer Protection Commission (“CCPC”) or the European Consumer Centre Ireland for information and assistance regarding consumer rights. You should contact us first so that we have an opportunity to resolve your complaint directly.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our products, services, the Site, legal requirements or business practices.

The version of the Terms in force when you place an order will apply to that order, unless a change is required by law or is necessary to correct an error.

We will not use an amendment to remove or restrict statutory rights that apply to you.

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it valid. If it cannot be made valid, it will be removed and the remaining provisions will continue in effect.

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.
